In terms of moral claims, the proponents of capital punishment believe that one cannot prove that capital punishment does not deter crime. The proponents’ claims are for the most part moral and hypothetical rather than empirical. For instance, the proponents believe that if capital punishment does not act as a deterrent, we might as well abolish the prison system altogether because this would mean that it does not scare criminals from committing crimes (prodeathpenalty.com). As one can deduct, this argument is highly irrational because it does not take into account that criminals may commit crimes regardless of the consequences and it is important to confine them in order to keep them from committing more crimes.
 
The proponents believe that capital punishment, psychologically, represents “a very high cost for committing murder,” thus its very existence is a deterring factor (Mocan & Gitting). However, this again is a moral claim since it is not backed up by any empirical evidence.
 
Opponents of the death penalty have moral claims as well. Over 80% of criminologists who research the psychology of criminals at the Academy of Criminal Justice Sciences believe that deterrence is not a justification for the death penalty (M. Radelet and R. Akers, Deterrence and the Death Penalty: The Views of the Experts, 1995). Even the public opinion seems to support the opponents’ view that capital punishment is not a deterrent.
 
The May 2004 Gallup Poll found that 62% of people polled do not believe that capital punishment is a deterrent. The same survey shows that 71% of the polled in April, 2004 favor death penalty. Thus, it can be deducted that (the lack of) deterrence is not the main reason people (oppose or) favor capital punishment even though the hope for deterrence is often stated as the main reason for the use of capital punishment (PollingReport.com).
